Colonel James Smallwood represented Charles Cty, MD, in the General Assembly from 1692 until his death in 1714. (His will, charles Cty, MD, 9/16/1712, probated in Charles Cty, 1/12/1714-15.)

James Smallwood was born in 1639 in Middlewich, Chester, England.3,16,1,11 He immigrated in 1664 to Charles Co., Maryland.  Warrants at Annapolis for lands in payment for the expense of transportation of himself in 1664 and Hester, his wife, in 1650.  He was awarded 100 acres.  He was a tabacco planter from 1665 to 1710 in Charles Co., Maryland.  He held many posts in the community including on April 8, 1692 when he was appointed to deal with the Indians since he was a near neighbor and acquainted with most of the Indians of the county.  He signed a will in 1714 in Charles Co., Maryland.  He died before Jan 1714/15 in Prince George Co., Maryland.  He lived most of his life in Charles County, but was living on his wife's plantation in St. Georges County at the time of death.  One source indicates that he died in Prince Charles County.  His Will was proved in 1715 in Prince George Co., Maryland.  The will is filed in Volume 14, Page 31. In Charles County, Maryland he owned "Zachia Hundred" 23 September 1669, "Goates Lodge", "Welcome", "Eltham" (75 acres, 10 June 1681), "May Day", "Tatshall", "Park Hall", "Bachelors Hope" (184 acres, 10 November 1695), "Bachelors Delight", "Porke Hall" (110 acres, 15 March 1689), and others.  They were all hundreds of acres of land. He was awarded many parcels of land.

He was a member of Godfrey's Rangers protecting the western limits of settlement along the Piscataway Creek.  In 1678, he was appointed postmaster for Charles County.  In 1692 he was authorized organize a military unit for an area east of Port Tobacco Creek, north of Potomac River, within Port Tobacco Parish.  From 1692 until his death, he represented Charles County in the Maryland Assembly.  He was appointed Major of Foot about 1692, he was High Sherrif of Charles County in 1694, and Lt. Colonel of the militia in 1700.  He was a member of the Maryland Assembly from Charles County from 1692 to 1714.

There were a few Smallwood's in the Baltimore area about this time, however, none appear to be related to the Smallwood's of Charles County and the neighboring counties.  Smallwoods descended from James were the predominant bearers of that name in Maryland until recent times.  There is a John Prior referenced in various sources in 1682, and later there is a child Prior Smallwood, so John may have been a relative.

He was married to Hester EVANS (daughter of William EVANS and __________?) about 1665 in Maryland.  One source indicates that the date of marriage was 1665.  He arrived in America unmarried.  Hester EVANS was born about 1640 in England.  One source indicates that she was born in Maryland.  She immigrated in 1650 to Maryland.  She immigrated with her parents.  She died on 10 Mar 1693 in Charles Co., Maryland.  She was also known as Esther.  She is mentioned, as living, in a court record of August 1692, but not mentioned in the will of her son, John in March 1693.  Her husband, James, remarried before May 1694.

One source indicates that Hester's surname was Nichols, daughter of John Nicholls, however, her father married the widow of John Nicholls.
